GENERAL TERMS AND CONDITIONS

1. CONTRACTUAL TERMS

All deliveries are exclusively subject to the following General Terms and Conditions of Brauerei Locher AG. Unless otherwise agreed in writing by Brauerei Locher AG, any General Terms and Conditions of the purchaser that deviate from these Terms and Conditions shall not be valid.

 

2. DELIVERY CONDITIONS

2.1 Delivery area:
The delivery area is limited to Switzerland and the Principality of Liechtenstein.

2.2 Delivery type:
Delivery is made by a Swiss parcel service. For orders of 60 kg or more, delivery will be made via a Swiss forwarding agent.

2.3 Delivery periods:
Dispatch usually takes place within 1 to 2 working days after receipt of payment. If the ordered items are not in stock, we will inform you via e-mail or phone.

Orders of chilled fresh products placed before 3:00p.m. are usually delivered the following day. However, please note that no deliveries of chilled fresh products will be made on Saturday, Sunday and Monday.

2.4 Delivery costs:
The delivery costs for a shop order are CHF 11.95. These costs are waived for orders over CHF 85.

2.5 Terms of delivery:
We expressly reserve the right to restrict our product range.

3. Orders:
Orders can only be placed via our online shop.

 

4. CONCLUSION OF THE CONTRACT
5. A) Orders less than CHF 1,000.00:
   Provided that the total invoice amount of the order is less than CHF 1,000.00, the contract shall be deemed concluded as soon as the purchaser has received the invoice number. The provision in clause 8 remains unaffected.
6. B) Orders starting from CHF 1,000.00:
   For orders with a total invoice amount of CHF 1,000.00 or more, the contract shall be concluded unless Brauerei Locher AG notifies the purchaser in writing within 10 days of receipt of the order number that it does not accept the order. The provision in clause 8 remains unaffected.
   
   In case the order has to be rejected by Brauerei Locher AG, any payments already made will be refunded free of charge.

 

5. PAYMENT TERMS

Products ordered from our website can be paid as follows:

1. Advance payment:

Upon completion of the order you will receive an order number. Please transfer the total amount to the following account stating your order number: IBAN CH72 0900 0000 9000 0626 9

After receipt of payment by Brauerei Locher AG, your order will be processed. If no payment is made within 15 days after the order number has been communicated to the purchaser, the order will be cancelled.

2. Instant payment:

We accept the following means of payment:

- Postcard

- Twint

- Eurocard/Mastercard

- Visa

 

6. PRICES

The prices include statutory VAT and recycling/disposal fees (prepaid disposal fee, VEG). All prices are quoted in Swiss francs (CHF).

Price changes:
Brauerei Locher AG may change or adjust prices at any time. For orders already confirmed, the agreed prices shall apply. The price of the order is binding unless there are obvious errors in pricing (e.g. programming errors).

 

7. RECYCLING SURCHARGE (ALUMINIUM CANS)/PREPAID DISPOSAL FEE FOR GLASS (VEG)

Aluminium cans:
- CHF 0.01

Disposable bottles:
- up to 0.33 litres: CHF 0.02
- up to 0.60 litres: CHF 0.04
- more than 0,60 litres: CHF 0.06

The recycling surcharge is already included in the price. Please ensure proper disposal. Thank you!

 

8. AVAILABILITY

Delivery is subject to availability. Promotional or seasonal items are only available in limited quantities. Therefore, individual items may be out of stock. In this case, we reserve the right to make partial deliveries upon prior written notice. For partial deliveries, the payment made will partially refunded or credited at the request of the purchaser.

 

 

9. RETURN EXCLUDED

Delivered items cannot be returned. In the case of obvious defects, only the purchase price will be reduced or, at the request of the purchaser, a replacement delivery will be made.

 

10. DEFECTS
11. A) Obvious defects:
    Obvious defects must be reported to Brauerei Locher AG in writing (e-mail, fax or post) no later than 10 days after receipt of the delivery. In case of postal notification, the date of the postmark will be considered the date of notification. Hidden defects must also be reported in writing (e-mail, fax or post) within 10 days of discovery, otherwise no credit note or replacement delivery will be made. In case of postal notification, the date of the postmark will be considered the date of notification.
    
    B) Damages:

In case the containers of the goods ordered are damaged or incomplete, this must be reported to Brauerei Locher AG immediately in writing. Depending on the nature of the damage, the parties will determine whether a credit note or a replacement delivery will be made.

 

11. SECURITY AND DATA PROTECTION

Your safety is of utmost importance to us. That's why we use SECURE SOCKET LAYERS (SSL), a sophisticated security system, to provide security to the data that is transferred. Your order details, such as your name and address, are encrypted and stored on a server that is protected from unauthorized access. We also guarantee that we will not pass on your details to any third parties. All payment transactions are processed via Saferpay (Six Payment Services). No data is stored by us in this regard.

 

12. MINIMUM AGE FOR THE CONSUMPTION OF BEER AND SPIRITS

By placing an order, the customer confirms that he/she has reached the age of 16 (for alcoholic beverages) or 18 (for spirits) and is therefore legally entitled to purchase the alcoholic beverages and spirits offered. Brauerei Locher AG shall not be held liable in any way. If it comes to the attention of Brauerei Locher AG that a customer is in breach of this provision, the purchase agreement shall lose its validity with immediate effect.

 

13. APPLICABLE LAW AND JURISDICTION

Only Swiss national law applies. The provisions of the Private International Law (Internationales Privatrechtsgesetz, IPRG) are not applicable.

In the event of disputes arising from this contract, the ordinary courts of 9050 Appenzell, Switzerland shall have exclusive jurisdiction.

 

14. SEVERABILITY CLAUSE

If any of the above provisions shall be held to be invalid, the validity of the remaining provisions of the contract shall not be affected. Verbal side agreements shall be deemed binding only if they have been confirmed in writing.
